Terms and Conditions

1. Introduction

Welcome to Elite Old Age Home. These Terms and Conditions ("Terms") govern your use of our services. By signing this document, you agree to comply with these Terms. If you do not agree with any part of these Terms, please do not use our services.

2. Admission and Residency

2.1 Eligibility

  • Residents must be of age 60 or older, unless otherwise agreed upon by the management.
  • Residents must provide complete and accurate personal, medical, and financial information during the application process.

2.2 Admission Procedure

  • Submission of a completed application form.
  • A personal interview and medical assessment.
  • Payment of the admission fee and first month's service charge.

2.3 Residency Agreement

  • Residents must sign a residency agreement outlining the services provided and the corresponding fees.
  • The residency agreement is renewable annually, subject to the resident’s compliance with the Terms and satisfactory performance of the home’s services.

3. Services Provided

3.1 Housekeeping

  • Daily dusting and cleaning of rooms.
  • Daily changing of bed linen.
  • Trash pick-up and bed tea service.
  • 24/7 availability of an in-house manager and attendant.

3.2 Healthcare

  • Emergency medical response services.
  • Availability of a physician.
  • Home nurse assistance.
  • Diet and nutrition chart-based meals for prescribed residents.
  • Quarterly health checks.

3.3 Ambulance Service

  • Well-maintained and hygienic ambulance service.
  • Transport to hospitals or health check centers.
  • Home nurse accompaniment for hospital visits.

3.4 Club and Recreation

  • Library and reading room.
  • Movies on demand.
  • Internet and Wi-Fi access.
  • Daily journals and magazines.
  • Board games.
  • Celebration of birthdays and festivals.

3.5 Doctors Chamber

  • Regular doctor visits.
  • Assistance during check-ups.
  • Maintenance of health files.
  • Regular checks of blood pressure and sugar levels for at-risk residents.

3.6 Small Scale Farming/Gardening

  • Opportunities for residents to engage in gardening.
  • Growing vegetables and flowers in-house.
  • Fish growing pond with seating areas.

4. Financial Terms

4.1 Fees and Charges

  • Residents are required to pay a monthly service charge covering accommodation, meals, healthcare, and other services.
  • Additional charges may apply for specialized medical care or other extra services.

4.2 Payment Terms

  • Payments must be made by the first day of each month.
  • Late payments will incur a penalty of 5% of the monthly fee for each week overdue.

4.3 Refund Policy

  • The admission fee is non-refundable.
  • Pro-rated refunds of the monthly service charge will be considered if the resident leaves due to health reasons or other valid circumstances, as determined by management.

5. Resident Responsibilities

5.1 Personal Conduct

  • Residents must behave respectfully towards staff and other residents.
  • Harassment, violence, or disruptive behavior will not be tolerated and may result in termination of the residency agreement.

5.2 Property and Belongings

  • Residents are responsible for the care of their personal belongings.
  • Elite Old Age Home is not liable for any lost, stolen, or damaged items unless caused by staff negligence.

5.3 Health and Safety

  • Residents must comply with all health and safety guidelines.
  • Smoking is prohibited within the premises, except in designated areas.
  • Residents must inform the management of any contagious diseases or medical conditions that could affect others.

6. Termination and Discharge

6.1 Voluntary Termination

  • Residents may terminate their residency agreement by providing 30 days' written notice.

6.2 Involuntary Termination

  • The management reserves the right to terminate the residency agreement for non-compliance with the Terms, non-payment of fees, or behavior that endangers the safety and well-being of others.

6.3 Discharge Procedure

  • Upon termination, residents must vacate the premises within the notice period.
  • All personal belongings must be removed, and any outstanding fees settled.

7. Privacy and Confidentiality

7.1 Data Protection

  • Personal data of residents will be collected, stored, and processed in accordance with applicable privacy laws.

7.2 Confidentiality

  • All personal and medical information of residents will be kept confidential and only shared with authorized personnel as necessary for providing services.

8. Liability and Indemnity

8.1 Limitation of Liability

  • Elite Old Age Home will not be liable for any indirect, incidental, or consequential damages arising out of the use of our services.
  • Our liability for direct damages will be limited to the total amount of fees paid by the resident in the preceding six months.

8.2 Indemnity

  • Residents agree to indemnify and hold harmless Elite Old Age Home from any claims, losses, damages, or expenses arising from their actions or omissions.

9. Complaints and Dispute Resolution

9.1 Complaints Procedure

  • Residents can report any complaints or concerns to the in-house manager.
  • All complaints will be addressed promptly and confidentially.

9.2 Dispute Resolution

  • Any disputes arising out of these Terms will be resolved through mediation.
  • If mediation fails, disputes will be subject to arbitration under the rules of the local jurisdiction.

10. Amendments to Terms

10.1 Changes to Terms

  • Elite Old Age Home reserves the right to amend these Terms at any time.
  • Residents will be notified of any changes in writing at least 30 days before they take effect.

10.2 Acceptance of Amendments

  • Continued use of our services following notification of changes constitutes acceptance of the amended Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Elite Old Age Home operates.
